Although the 2018 Farm bill made growing, processing and selling hemp products legal, major hurdles remain when it comes to buying and selling plant material. My credit card processing company for example has recently told me that I need to remove “ingestible CBD/hemp sales” from my website. They have also insisted that I stop charging for the sale of those products using their credit card service.
I am currently looking for a new credit card servicing provider that will allow for CBD sales. Some providers do process CBD materials, but the rates are high and access is currently limited. Meanwhile, my patients and my online clients are reporting appreciation for what this plant medicine is doing for them. Although this new farm project will take some time to become profitable, I see the value of this herb as too important to discontinue working with it.

Currently a bill is in the House of Representatives that will potentially bring an end to this log jam. The Bill H.R. 5587 aims to classify hemp-derived CBD as a dietary supplement thereby circumventing some of the prohibitions established by the FDA. The bill has been referred to the Subcommittee on Biotechnology, Horticulture, and Research.
